District Court Judge Grants Preliminary Injunction in Missouri v. Biden

On July 4, the U.S. District Court for the Western District of Louisiana granted a preliminary injunction in part in the case of Missouri v. Biden, concluding that the plaintiffs are likely to succeed on the merits of their First Amendment free speech claim, but denied their request to certify the matter as a class action lawsuit. 

In the case, the states of Missouri and Louisiana, along with multiple individuals, filed a lawsuit against the federal government for First Amendment rights violations. The plaintiffs argued that the federal government colluded with and coerced social media companies into censoring content relating to the coronavirus pandemic and the Hunter Biden laptop story. In granting the preliminary injunction, Judge Terry A. Doughty restricted parts of the federal government from communicating with social media companies “for the purpose of urging, encouraging, pressuring, or inducing in any manner the removal, deletion, suppression, or reduction of content containing protected free speech posted on social-media platforms.”
