DNI Releases Semiannual Section 702 Report

On Aug. 10, the Director of National Intelligence released its 21st Joint Assessment of Section 702 Compliance, which covers June 1, 2018 to Nov. 30, 2018. The semiannual report is produced in compliance with the FISA Amendments Act of 2008. According to a press release accompanying the report, it found “that the agencies continued to implement the procedures in a manner that reflected a focused and concerted effort by the Intelligence Community (IC) personnel to comply with the requirements of Section 702.” This is in spite of a significant increase in the overall compliance incident rate, which the press release attributes to “two incidents made up almost 99% of the IC’s compliance incidents . . . .”
