A grand jury in the Eastern District of Virginia indicted James Comey on two counts.

On Sept. 25, 2025, a grand jury in the Eastern District of Virginia indicted former FBI Director James Comey today on two counts arising out of his testimony before the Senate Judiciary Committee on Sept. 30, 2020. The first count alleges that Comey violated 18 U.S.C. 1001 by falsely stating that he had not authorized anyone at the FBI to be an anonymous source regarding a specific FBI investigation. The second count alleges obstruction of a Congressional proceeding in violation of 18 U.S.C. 1505.

The indictment comes days before the five-year statute of limitations would have expired, and days after President Trump stated in a post directed at Attorney General Pam Bondi that Comey should be indicted.
